    China Truer IP attended the lecture of Practice on Design Patent Application and Its Protection Trend held in Shenzhen. The lecture was presented by the Director of the Design Examination Department of SIPO Director Lin Xiaoyue. In the lecture, Director Lin mainly introduced the design patent application, its grant conditions and grant procedure. Moreover, Director Lin especially pointed out the Design E-filing System and the Hague Agreement concerning the International Deposit of Industrial Designs.

    The application system for China design application is registration system and mainly uses manual examination, therefore, the examination period for design application may last 6-12 months previously. Whereas, now the Design Examination Department adopts the Design E-filing System. By using the electronic intellectual management, repetitive examination caused by repetitive filings can be avoided. Moreover, the Design Examination Department increases the examiners. All these shorten the examination period to about 3 months.

    Director Lin also mentioned that China may join the Hague Agreement concerning the International Deposit of Industrial Designs. If joining the Hague Agreement, China should try to be the examination office and apply Chinese to be the working language. At present, some developed countries like US, Japan have not joined the Hague Agreement yet, if China becomes the contracting states, our Chinese shall have the initiative.
